外汇交易在我国是否受法律保护?
1、根据《关于严厉查处非法外汇期货和外汇按金交易活动的通知》(证监发字[1994]165号)规定凡未经批准的机构在大陆境内擅自开展外汇期货交易均属非法。
2、国家的外汇交易政策:中国有明确法律规定，国内不得设立公司进行组织公民炒汇活动，但是国家不干涉公民参与国外接受正规监管的外汇平台做海外投资。目前中国投资者投资外汇的方式主要有两种:一种是国内银行开设的外汇实盘交易(比如中国银行);另一种是通过国外交易商在国内的代理机构直接在国外开户。
3、综上所述:外汇在中国属于法律的灰色地带，是不受到国家法律保护的。但也没有违法，因为无法可依。既没有允许也没有强行禁止，都属于个人行为，境外投资。因此，想参与外汇交易，要么选择正规的受国外监管的外汇平台，要么就做银行的实盘交易。
