以净资本不足为由！美国CFTC对三家经纪商处以36万美元罚款
据最新消息，美国商品期货交易委员会(CFTC)对三家注册经纪商(IB)提起诉讼并已与他们达成和解。这三家经纪商分别是EOX Holdings LLC、Futures International LLC以及OTC Europe LLP。
具体而言，这三家经纪商将分别支付12万美元的民事罚款，并承诺不再进一步违反《商品交易法》(CEA)和商CFTC的规定。CFTC同意它们的和解补救措施，这也进一步确保了它们履行其作为注册者的义务。
CFTC发现，这三家经纪商在计算经调整后的净资本时，不当计入了因其为关联公司提供循环信贷额度担保协议而产生的扣减。这三家三家经纪商为循环信贷额度提款担保人期间，为关联公司的利益，每月从信贷额度中提取资金，金额从1000万美元到2600万美元不等。然而，这三家经纪商在计算调整净资本时均未按要求扣除担保提款金额。
因为如果这样做，这三家经纪商中任意一家的净资本将低于CEA和CFTC法规要求调整后的净资本，从而导致赤字从大约900万美元至2500万美元不等。
