【行业动态】安达嘉盛爆发专利之战！安达：赔钱，嘉盛：休想！
两著名外汇经纪商安达（OANDA Corporation）和嘉盛（GAIN Capital）因专利侵权纠纷在法庭上起了争执。
安达已在新泽西州（ New Jersey）联邦地区法院对嘉盛集团及其子公司GAIN Capital Holdings，Inc.提起诉讼，指控嘉盛侵犯了其专利著作权。 该案涉及的两项核心专利分别是：“366专利”（美国专利号7,146,336）和“311专利”（美国专利号8,392,311）。
安达声称，嘉盛在其网站（https://forex.com）上制造、使用、已出售/正在出售涉嫌侵犯安达专利著作权的APP、API等工具。此外，嘉盛还已将这些侵权工具用于操作自动交易系统。
安达坚称，他们已经以信件形式告知嘉盛其侵权行为，且在信中特别提到了“366专利”，但嘉盛仍不顾侵权事实，继续运营其在线交易平台和系统。
安达已在庭上请求，根据相关要求核算被告嘉盛应就过去以及未来（直至安达专利到期之日为止）的侵权行为赔偿原告多少损失。
嘉盛辩称，安达在指控中仅提到了嘉盛的一个网站，并未指明具体的侵权产品，也未解释是如何构成侵权的，其指控远未达专利侵权诉讼要求。
安达的指控和恳求陈腐且敷衍。在之前的案例中，此类指控均被法院认定为不可诉。因此，嘉盛请求法院驳回安达的起诉。
