CFTC 等多个监管机构发布 Safeguard Metals 欺诈案的同意令
美国商品期货交易委员会（CFTC）和北美证券管理协会（NASAA）成员的 30 个州的证券监管机构近日宣布，美国加利福尼亚州中区地方法院对 Safeguard Metals LLC 和 Jeffrey Ikahn（原名 Jeffrey Santulan，又名 Jeffrey Hill）应对一项价值 6,800 万美元的欺诈案负责，该案涉及他们以老年人和退休人员为目标高价销售假银币。
该命令认定，Safeguard Metals 和 Ikahn 从 2017 年 10 月左右至 2021 年 7 月期间在全国范围内实施了欺诈行为，被告在此过程中募集并接收了约 6,800 万美元的投资者资金。大部分资金是从约 450 人处募集的退休储蓄，用于购买贵金属，主要是银币。
该命令认定，被告的欺诈计划涉及通过虚假和误导性陈述欺骗客户购买贵金属，包括关于传统退休账户投资的风险和安全性的陈述。
被告还欺骗客户购买银币，这些银币的标价严重虚高，大大超出了向客户披露的标价。此外，为了掩盖他们的欺诈计划，被告还误导客户他们所购买的银币的真实价值。
除了认定被告应承担欺诈责任外，该命令还禁止他们今后违反《商品交易法》（CEA）和 CFTC 的相关规定；禁止他们今后违反各州的法律法规；禁止他们在 CFTC 和各州进行交易或注册。该命令还保留了对恢复原状、交出罚金和民事罚款金额的决定权，由法院在今后作出裁决或经双方同意后作出裁决。
