香港金银业贸易场只是行业协会，并不是政府的监管职能机构，没有任何的监管职权。
贸易场的理监事会的成员全部都是各黄金公司的负责人，既是运动员又当裁判，无法保证监管的公正和透明。
香港证监会规定金融投资只能最高20倍杠杆，但是香港金银业贸易场的黄金保证金公司基本都是100倍杠杆，大大超过了香港证监会规定。
香港的黄金交易公司很多都用个人的中转银行接收汇款，并且可以用第三方汇款，完全没有遵守国际间对洗钱和金融风险控制的规定。
香港金银业贸易场对于中天、恒信等公司的违法行为既没有事前预警，也没有事后处理，反而只是出具公告极力撇清关系，推卸责任。
