中华人民共和国国旗法规定
国家倡导公民和组织在适宜的场合使用国旗及其图案，表达爱国情感。
公民和组织在网络中使用国旗图案，应当遵守相关网络管理规定，不得损害国旗尊严。
国旗及其图案不得用作商标、授予专利权的外观设计和商业广告，不得用于私人丧事活动等不适宜的情形。
中华人民共和国国徽法规定
国徽及其图案不得用于：
(一)商标、授予专利权的外观设计、商业广告；
(二)日常用品、日常生活的陈设布置；
(三)私人庆吊活动；
(四)国务院办公厅规定不得使用国徽及其图案的其他场合。
