ASIC暂停Ballast Financial Management Pty Ltd的AFS执照
澳大利亚证券及投资委员会(ASIC)日前宣布暂停位于珀斯的金融咨询提供商Ballast Financial Management Pty Ltd（Ballast）的澳大利亚金融服务（AFS）牌照（编号：233180），直到2020年12月18日。
暂停牌照的原因是Ballast已经停止开展金融服务业务。根据《2001年公司法》第915B条，如果被许可人停止开展金融服务业务，ASIC可以在不举行听证会的情况下暂停或取消AFS牌照。
Ballast在无法获得专业赔偿保险以履行其作出适当赔偿安排的义务时，便停止从事金融服务业务。
根据《2001年公司法》第912B条，AFS持牌人必须作出安排，对零售客户因持牌人或其代表违反第七章义务而遭受的损失进行赔偿。
10周的停牌将使Ballast有足够的时间作出适当的赔偿安排。也将为Ballast提供一个机会，在其前任责任经理辞职后，找到并任命一位具有适当资格和经验的责任经理。
ASIC表示，如果Ballast无法证明其在10周停牌期结束前有能力重新开展金融服务业务，ASIC将考虑取消其牌照。
