智通财经APP获悉，东亚银行有限公司（东亚银行）因没有依监管规定分开存放客户证券，遭香港证券及期货事务监察委员会（以下简称“香港证监会”）谴责及罚款420万元。
香港证监会在接获香港金管局的转介及东亚银行自行报告有关事件後进行调查，发现东亚银行在2003年4月1日至2016年12月5日期间，没有将分别存放于两名外部保管人（即中央结算及交收系统和Sumitomo Mitsui Banking Corporation, Tokyo）所维持的帐户内的客户证券与自营证券分开保管。
根据香港《证券及期货（客户证券）规则》第5(1)条规定，凡中介人或中介人的有联系实体收取任何客户证券，都必须在合理切实可行的范围内尽快确保客户证券存放于被指定为信托帐户或客户帐户的独立帐户内作稳妥保管，而该帐户是该中介人或该有联系实体为持有客户证券的目的在香港于认可财务机构、核准保管人或其他获发牌进行证券交易的中介人所开立或维持的。
香港证监会指出，虽然东亚银行在其内部电子会计纪录内已识别出有关客户证券，但它没有遵守有关持牌法团须将客户证券保管在被指定为信托帐户或客户帐户的独立帐户内的监管规定。
